Terms of Use Agreement

Welcome to PaizoMath (the “Platform”), operated by Second Job Studios LLC (“Company,” “we,” “us,” or “our”). By accessing or using PaizoMath, you agree to these Terms of Use (“Terms”). If you do not agree, you may not use the Platform.

1. Eligibility

You must be 18 years of age or older (or the age of majority in your jurisdiction) to create an account, purchase a subscription, or otherwise enter into these Terms.

Students under 18 may use the Platform only as “Authorized Users” under an account created and managed by a parent, legal guardian, teacher, or school administrator.

If you create an account that allows student access, you represent and warrant that:

• you have the legal authority to do so,
• you consent to the student’s use of the Platform, and
• you accept full responsibility for the student’s activity on the Platform.

2. Account Registration

An account is required to access subscription content.

You agree to provide accurate and complete information during registration.

You are responsible for:

• maintaining the confidentiality of your login credentials,
• any activity occurring under your account, and
• managing access for Authorized Users (students).

You may not allow other adults to use your account unless explicitly permitted under your subscription plan.

3. Subscriptions and Payment

• Access to the Platform is granted through subscription plans, with features and student limits determined by the plan purchased.
• Subscription fees, renewal periods, and payment terms are provided during checkout.
• Fees are non-refundable except where required by law or explicitly stated by us.
• You authorize us or our payment processor to charge your provided payment method for recurring subscription fees until you cancel.
• You may cancel your subscription at any time through your account settings; cancellation becomes effective at the end of the current billing cycle.

4. Use of the Platform

You agree to use the Platform only for lawful and educational purposes. You may not:

• copy, modify, or distribute Platform content except as allowed by your subscription,
• attempt to access data or accounts belonging to others,
• use the Platform to harass, exploit, or harm students or other users, or
• interfere with the security, performance, or integrity of the Platform.

5. Student Data and Privacy

• Teachers and parents may input limited student information, including first name, last name, class group, and gameplay progress.
• You agree that you have obtained any necessary consent required before entering student data.
• Student data handling is governed by our Privacy Policy, which explains compliance with COPPA, FERPA (where applicable), and relevant state laws.
• We do not require students to provide contact information or create accounts.

6. Intellectual Property

• All content on the Platform—including games, text, graphics, software, and trademarks—is owned by Second Job Studios LLC or its licensors.
• You are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely for personal or educational use under these Terms.
• You may not reverse-engineer, copy, resell, or exploit Platform content.

7. Termination

We may suspend or terminate access to your account if:

• you violate these Terms,
• you misuse the Platform, or
• required payments are not made.

You may cancel your account at any time, effective at the end of the billing period. Upon termination, access to all Platform features for you and your Authorized Users will cease.

8. Disclaimers

The Platform is provided “as is” and “as available” without warranties of any kind, either express or implied.

Your use of the Platform is at your own risk. We do not warrant that:

• the Platform will be error-free, uninterrupted, or secure,
• gameplay data or analytics are free of inaccuracies or delays, or
• the Platform meets your educational objectives.

To the fullest extent permitted by law, all warranties are disclaimed.

9. Limitation of Liability

To the maximum extent permitted by law, Second Job Studios LLC and its affiliates shall not be liable for:

• indirect, incidental, or consequential damages,
• loss of data, profits, or goodwill,
• unauthorized access to your account,
• issues arising from Authorized Users’ access to the Platform.

Our total liability to you for all claims will not exceed the amount you paid in subscription fees in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Second Job Studios LLC, its employees, and affiliates from claims, liabilities, or expenses arising from:

• your misuse of the Platform,
• your violation of these Terms, or
• your management or supervision of Authorized Users.

11. Changes to Terms

We may update these Terms periodically.

If we make material changes, we will notify you via email or through the Platform.

Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules.
